Terms and Conditions
Welcome. We look forward to your attending Masquerade and being a guest of our Venue 218 W 57th Street (the “Venue”). While we hope to provide you with a memorable and exciting experience of this re-imagined classic, please note that no one under sixteen (16) years of age will be admitted and it is unlawful to serve or sell alcohol to anyone under the age of 21. All Guests should be prepared to show your evening’s Hosts a government issued form of personal identification to verify your age (i.e. Passport/Driver’s License/Non-driver I.D.) upon your arrival.
This experience takes place on multiple floors and guests will be moving both throughout the venue; and, in dimly lit and dark spaces over the course of the event; furthermore guests may experience strobing lights, theatrical haze, theatrical fog, exposure to open flame, exposure to white fuel, high-impact automation and rigging elements, exposure to the elements (ie. outdoors) continuous immersion, close-proximity with performers and audience members, extremely loud music and sound effects.
The Ticket Holder acknowledges and understands that this Venue and Show environment may not be suitable for individuals who are pregnant, have heart conditions, back or neck issues, motion sickness, anxiety, Post-Traumatic Stress Disorder (PTSD), and/or are neurodivergent or sensitive to their surroundings. Also, please be advised that video surveillance is in operation throughout the premises.
By entering the Venue, the Ticket Holder acknowledges and agrees that you may be photographed, filmed, and/or otherwise recorded and your grant of the unrestricted right to use your likeness, voice, and name in any and all media now known or hereafter devised, throughout the world and in perpetuity, for any purpose whatsoever, including but not limited to promotional, marketing, legal and commercial use by Production & Concession POTO LLC, the Venue, sponsors and affiliated partners, without compensation or further notice.
By either (i) purchasing a ticket(s) and/or by having a ticket; (ii) entering the venue; and/or, (iii) participating in the immersive theatrical experience Masquerade (“the Show”), The Purchaser and/or the Ticket Holder (“Ticket Holder” or “Holder”) agree to be bound by these Terms and Conditions.
I. Assumption of Risk/Release
As consideration for being permitted to visit 218 W 57th Street and attend the Show, you, the Ticket Holder, hereby release Production & Concessions POTO LLC, Investor POTO LLC, 218 W 57th Owner and each of their respective directors, officers, employees, volunteers, agents, contractors, and representatives (collectively “Releasees”) from any and all actions, claims, or demands that you, your assigns, heirs, distributes, guardians, next of kin, spouse, and legal representatives now have, or may have in the future, for injury, death, including but not limited to any injury or death resulting from exposure to food or beverage allergies, food borne illnesses or choking, virus or infectious disease, theft or property damage, related to your visit and interaction with staff.
The Risks include, but are not limited to:
- Physical Injury or Harm from dark or dimly lit surroundings, use of stairs, fog, haze, strobe lighting, uneven flooring, obstacles, rapid transitions, or other visual or sensory hazards. Injury (including death), property damage, illness (including from communicable disease), financial loss, or emotional distress
- Psychological or Emotional Distress from intense audio-visual effects, nudity, depictions of violence or sexuality, psychological scenarios, or sudden environmental changes.
- Crowd-Related Risks, such as accidental or incidental contact with other attendees, stampedes, or separation from companions.
- Health Risks, including exposure to illness, extreme temperatures, fatigue, or any adverse reactions due to the Holder’s own health conditions or the environment.
- Negligence by Other Patrons, active or passive including but not limited to reckless behavior, running, jumping, or any conduct beyond the control of the production.
- Other Hazards, including but not limited to pyrotechnics, smells, loud noises, lasers, confined or disorienting spaces, or other sensory stimuli.
- Contact, Guests may come into close contact with tactile clothing and theatrical effects including but not limited to theatrical blood, haze, fog and more.
This Release shall apply regardless of whether the risks are caused by the nature of the Show, your own conduct, the conduct of others, or any act or omission of any Released Party.
Guests must conduct themselves in a manner that does not endanger themselves or others. For the safety of all of the Guests, Performers and Staff, each Guest is required to comply with any verbal or nonverbal instructions directed to the Guests from the Performers and the Staff; and, any and all applicable safety protocols and posted signage while at the Venue.
The Releasee(s) reserve the right to modify or implement additional health and safety measures at any time, including but not limited to limiting capacity, requiring face coverings, temperature checks, sanitation procedures, and social distancing, in accordance with public health guidelines or at the Releasees’ sole discretion. Guests who fail to comply with any health and safety protocols may be denied entry or removed from the Venue without refund or credit.
By attending the Show, Guests acknowledge that they assume all risks related to exposure to communicable illnesses, including but not limited to COVID-19, and agree to hold the Releasees harmless from any resulting claims, liabilities, or damages, to the fullest extent permitted by law
II. Personal Responsibility
The Ticket Holder is solely responsible for assessing their own physical and mental fitness to attend or participate in the Show. By entering the venue, you affirm that:
- You understand and accept the risks identified herein.
- You and any companions under your care are able to and prepared to manage such risks.
- You will comply with all of the safety instructions, staff directives and posted signs.
- Disruptive Behavior. We are committed to providing a safe, respectful, and appropriate environment for all Guests, Performers and Staff within the Venue. Any Guest whose behavior constitutes a disruption that interferes with the experience of other Guests, or that hinders the ability of Performers and/or Staff to perform their duties, may be immediately removed from the Venue at the sole discretion of the Releasees. No refunds and/or credits will be issued in the event of removal. Guests who, in the sole judgment of the Releasees, appear to be unstable or under the influence of drugs or alcohol will not be admitted to the Venue.
The Releasee(s) reserve the right to remove, refuse admission, service, or the continued participation to any Guest, at their sole discretion for any of the reasons stated above, at any time, without refund.
III. Final Acknowledgment
The Ticket Holder understands and agrees that by choosing to attend the Show and enter the Venue that they have voluntarily chosen to participate; and, by attending the Show the Ticket Holder is accepting all of the terms herein.

BY ENTERING THE VENUE OR PARTICIPATING IN THE SHOW, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.
